Disclaimer

The information on this website is based on information provided to us and on the basis of inspections made by Custom Caribbean Vacations.  The information is deemed accurate and reliable but is subject to changes, errors, omissions and changes in pricing.

The description and photographs of each property is accurate at the time of inspection.  Any deviations or alterations made by the property management company or villa owner is subject to change without prior warning.  General refurbishment to the villas may result in changes to furniture, colors  schemes, soft furnishings or views.  We endeavor to inspect each property regularly and will update such information accordingly.   If changes are made after a confirmed reservation, we will use our best effort to advise you prior to the arrival date.

Changes to local conditions, such as bad weather or low season, public holidays and festivals can affect some facilities and amenities.
 
It is essential that you have the necessary insurance coverage for medical needs, cancellation of flights and/or delays, as well as personal liability insurance coverage as applicable or required.  It is also your responsibility to ensure that each member of your party travels with a valid passport and where necessary, a visa.

Custom Caribbean Vacations does not accept responsibility for any flight delays or cancellations, or for any loss, damage, disruption or cancellation of your holiday caused by force majeure or adverse weather conditions.  
 
Custom Caribbean Vacations cannot take responsibility for failure to provide prior warning or notice of existing or pending public works events, excessive noise zones, power or water interruptions, staff behavior or competence, or any other factors beyond our control.

Should problems occur, or if you have any queries or complaints during your stay, you must report your concerns immediately to the house staff or villa management for remedy.

A government departure tax of 25.00 Barbados Dollars is required for each person over the age of 12 and is the sole responsibility of each individual who departs the island.

Use of this site and any of its services, rentals, recommendations, or other offerings is an acceptance of the terms and conditions contained herein.

Cancellation Policy v1020908

A cancellation must be made in writing.
Our cancellation policy applies when the cancellation of a trip or tour is due to no fault of our own. In other words, Custom Caribbean Vacations has made all the required and necessary arrangements and reservations for your trip.

*Cancellation fees are per person as follows:
    - 91+ days before trip start: $150
    - 61 - 90 days before trip start: 35% of total price
    - 31 - 60 days before trip start: 40% of total price
    - 0 - 30 days before trip start: No refund

Private or custom trips have additional conditions, such as when you have ordered special services such as weddings, private parties.. Ask for details.

Change/Cancellation fees will be waived by Custom Caribbean Vacations:
    - In the event of serious illness to the passenger; upon receipt of a doctors certificate
    - In the event of death to an immediate family member; upon receipt of death certificate
    - Land packages are non-refundable for no-shows

Changes in Bookings
& Late Bookings

To ensure a reservation on a tour departing in 65 days or less, full payment is required at time of booking.

Booking within 14 days of departure is subject to a $15 late fee.

Any change made in your reservation once submitted to us (this includes, but is not limited to, any change made in names, meals, dates, room selection, any additional night(s) needed or retracted and so on) is subject to a $50 fee per change.
Above changes must be made 65 days prior to travel date, otherwise, other fees may apply.

A transfer of a confirmed reservation to another tour is subject to a $50 per person changing fee if done 65 days prior to travel date. Otherwise, other fees may apply.

Please allow sufficient time via regular mail for us to get all of your travel information out to you. Express mail can only be used at your expense when a tour is booked late, such as less than 40 days before departure, unless it is due to no fault of your own.

Upon confirmation of your reservation, Custom Caribbean Vacations will mail out a travel packet (only one per room/cabin/family) about 3-4 weeks prior to tour departure that includes information on local travel, hotel accommodations, travel insurance and so on. Obtaining travel and cancellation insurance is optional, but provides excellent coverage in case of tour cancellation, accidents and so forth. Additional trip packets can be provided for $15 extra per packet.

 Custom Caribbean Vacations retains the right to cancel a tour or trip under any circumstances. Should a tour or trip be cancelled, then you will be informed of this decision within 30 days (and at the least, 15 days) prior to departure of your trip or tour. Information regarding any of our trips or tours is subject to change, and we reserve the right to make changes should it become necessary.

Custom Caribbean Vacations does not own or operate any of the suppliers of services or accommodations for your trip or tour. As a result, Custom Caribbean   not responsible for any negligent or willful act or failure to act of any such supplier or of any other third party over whom Custom Caribbean Vacations has no control. Waiver and Limitation of Liability Statement and Assumption of All Risks and Release of Liability Agreement

LIMITATION OF LIABILITY STATEMENT

Custom Caribbean Vacations its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns does not own or operate any entity which provides, or is to provide, goods or services for your trip, including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, babysitters or daycare providers, etc.

Custom Caribbean Vacations responsibility is strictly limited. Custom Caribbean Vacations is not responsible for the acts or failures to act, willfully or otherwise, of its suppliers, or of any other third party over whom Custom Caribbean Vacations has no control. As a tour operator and travel agent, Custom Caribbean Vacations promotes, organizes and sells tours, which consist of surface transportation, excursions and accommodations that Custom Caribbean Vacations purchases or obtains from suppliers, who are themselves independent contractors separate from Custom Caribbean Vacations Insofar as Custom Caribbean Vacations is a participant in the sale of air transportation, Custom Caribbean Vacations acts as an agent of the air carrier, but is not responsible for the acts or failures to act, willful or otherwise, of any air carrier or their personnel. Any tickets, coupons or receipts issued are subject to the terms and conditions specified by the air carrier.

Custom Caribbean Vacations is not liable for any bodily injury or harm, accidents, property damage or personal loss as a result of, but not limited to: physical exertion for which the participant was not prepared; travel by plane, train car, bus, boat or other mode of transportation (such as bicycle, horse, foot, kayak, etc.); consumption of alcoholic beverages; high altitude; forces of nature, such as high winds, hurricanes, flooding, etc.; heat exhaustion, equipment failure; civil unrest or terrorism; or the availability of medical services in remote areas and the quality thereof. Custom Caribbean Vacations is also not liable for: expenses (e.g. meals, transportation, hotel costs) that are not specified as included in the price of the trip, but may be required to get to/from a starting or ending point. Custom Caribbean Vacations reserves the right to make hotel and/or route alterations in order to improve the quality of a trip or better accommodate its guests.

Custom Caribbean Vacations is not responsible for expenses incurred by guests in preparing for the tour (e.g. non-refundable advance purchase of air tickets, equipment, travel insurance, etc.) or for any additional travel arrangements made on your own.

ASSUMPTION OF ALL RISKS AND RELEASE OF LIABILITY AGREEMENT

I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip to which I may subsequently transfer). I am voluntarily participating in this trip with the knowledge of the numerous risks and dangers involved including but not limited to: Physical exertion for which I am not prepared; forces of nature; transportation failures whether by plane, train, auto, boat, canoe, kayak, bicycle, skis, horseback or other animal, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; civil unrest; terrorism; criminal activity; dangers associated with wild or other animals; breakdown or failure of bicycles or other equipment; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; and stolen, lost or misplaced luggage or property. I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, and are a reason for my participation. I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFFARE AND ACCEPT THE RISKS ASSOCIATED WITH THE TRIP.

I acknowledge that the cost of all Custom Caribbean Vacations trips is based upon trip participants executing this Assumption of Risk and Release of Liability Agreement. Therefore, as lawful consideration for being permitted to participate in such trip(s), I hereby RELEASE AND DISCHARGE FOREVER CUSTOM CARIBBEAN VACATIONS FROM AND AGAINST ANY AND ALL LIABILITY, EXCEPT LIABLILITY CAUSED BY NEGLIGENCE OF CUSTOM CARIBBEAN VACATIONS ,ARISING FROM MY PARTICIPATION IN THE TRIP. I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release Custom Caribbean Vacations from any and all liabilities to the maximum extent permitted by law.

Custom Caribbean Vacations reserves the right to increase the tour price in the event of cost increases due to changes in airfares, currency fluctuations, etc. Custom Caribbean Vacations reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice. Accommodations are subject to change.

Medical services or facilities may not be readily available or accessible during all or part of the trip. Travel insurance, cancellation insurance and medical insurance for abroad are the sole responsibility of the traveler. The traveler is responsible for selecting a trip appropriate to his/her abilities and interest. The traveler is responsible for being in sufficiently good health to undertake the trip, to prepare for the trip by studying the itinerary and pre-departure materials sent by Custom Caribbean Vacations and for bringing the appropriate clothing and equipment as advised therein. I understand that Custom Caribbean Vacations reserves the right to take photographic or film records of any of its trips, and to use any such photographic or film records for promotional and/or commercial purposes, including use by third parties with whom Custom Caribbean Vacations may engage in joint marketing, without any remuneration to me. I hereby assign to Custom Caribbean Vacations all right, title and interest I may have in or to any and all media in which my name or likeness might be used by Custom Caribbean Vacations

I understand that Custom Caribbean Vacations reserves the right to refuse as a trip participant, or remove from a trip, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who it determines to detract from the enjoyment of the trip by others. I agree to follow all written and verbal rules of safety presented to me by Custom Caribbean Vacations.  Custom Caribbean Vacations reserves the right to make route, hotel and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests.

KNOWING AND VOLUNTARY EXECUTION: I have carefully read and fully understand the contents and legal ramifications of this Limitation of Liability Statement and Assumption of All Risks and Release of Liability Agreement, and the brochures and all other materials provided to me concerning my trip, including, but not limited to, those regarding cancellation and refund policies. I understand that if I must cancel my reservation, the cancellation fee will be determined according to the following formula: Number of days prior to trip start/Cancellation fee per person. 91+ days/$150; 61-90 days/35% of tour price; 31-60 days/40% of tour price; 0-30 days/100% of tour price. Special cancellation/refund fees exist for Custom Caribbean Vacations issued tickets. Exceptions to this policy cannot be made for any reason, including weather, terrorism, civil unrest, personal or medical emergencies. I understand this is a legally binding and enforceable legal document and sign it of my own free will. I agree that if any portion of this Limitation of Liability and Assumption of All Risks and Release of Liability Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
